Terms of Service

These Terms constitute a legally binding agreement between you and HayaWeb. By creating an account or using the Service, you represent that: (a) you are at least 18 years of age; (b) you have the legal authority to enter into this agreement; and (c) all information you provide is accurate. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

HayaWeb provides an AI-powered website creation platform ("Service") designed for local service businesses — including but not limited to plumbers, electricians, landscapers, roofers, HVAC technicians, cleaners, painters, auto detailers, pest control operators, and general contractors. The Service enables users to:

• Input business information (name, type, description, contact details, logo) to generate a professional website using artificial intelligence
• Publish generated websites to a hayaweb.ai subdomain (e.g., yourbusiness.hayaweb.ai) on free and paid plans
• Connect a custom domain on paid plans
• Manage, regenerate, edit, and delete websites through a dashboard
• Access analytics and lead management features on paid plans
• Generate and manage multiple websites under Agency plans
• Offer white-label website creation services to clients under Agency plans

The Service is provided on an "as-is" basis and features may change, be added, or be removed at our discretion.

Passwordless Authentication. HayaWeb uses email-based one-time passcode (OTP) authentication. No password is stored. A 6-digit code is sent to your email address for each sign-in session and expires within 10 minutes. You are responsible for ensuring access to your email account is secure.

Account Responsibility. You are solely responsible for all activity that occurs under your account. You must notify us immediately at legal@hayaweb.ai if you suspect unauthorized access. We are not liable for any loss resulting from unauthorized use of your account.

One Account Per Person. You may not create multiple accounts to circumvent plan limits, free trial restrictions, or any access restrictions we impose.

Account Accuracy. You agree to provide accurate, current, and complete information and to keep it updated at all times.

Plans. HayaWeb offers the following subscription tiers:

Billing. Paid plans are billed on a recurring monthly basis. Your subscription renews automatically on the same day each month unless cancelled. By subscribing, you authorize us (or our payment processor) to charge your payment method on a recurring basis.

Cancellation. You may cancel your subscription at any time from your account dashboard or by contacting us at legal@hayaweb.ai. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.

Refunds. We offer a 7-day money-back guarantee for first-time paid subscribers. After 7 days, all charges are non-refundable. Refunds are not provided for partial months or unused features. To request a refund within the 7-day window, contact legal@hayaweb.ai.

Downgrades. If you downgrade to a lower plan, your account will be adjusted at the end of the billing cycle. Websites that exceed the lower plan's limits will be archived (not deleted) and reactivated if you upgrade again. Published websites that exceed publish limits after downgrade may be unpublished.

Price Changes. We reserve the right to change pricing at any time. We will provide at least 30 days' written notice (via email) before price changes affect active subscribers.

Failed Payments. If payment fails, we will retry for up to 7 days before suspending your account. You will be notified by email. Upon suspension, paid features are disabled but your data is retained for 90 days.

Ownership. You retain full ownership of all content you submit to the Service, including your business name, description, logo, contact information, images, and any other data you upload ("User Content").

License to Us. By submitting User Content, you grant HayaWeb a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify, and display your User Content solely for the purpose of providing and improving the Service — including generating your website, hosting it, and rendering previews.

Your Representations. You represent and warrant that: (a) you own or have the legal right to use all User Content you submit; (b) your User Content does not infringe any third-party intellectual property, privacy, or other rights; and (c) your User Content complies with all applicable laws.

Logo Uploads. Files uploaded must be image files (PNG, JPG, SVG), must not exceed 5 MB, and must be content you own or have rights to use. We reserve the right to remove any content that violates these Terms.

Content Accuracy. You are solely responsible for the accuracy of all information you provide. HayaWeb does not verify the truth, accuracy, or legality of your business information.

How It Works. Our Service uses artificial intelligence models to generate website content — including text, page layouts, service descriptions, and design choices — based on the business information you provide. The AI models we use may be provided by third-party AI infrastructure providers.

Ownership of Output. AI-generated content created from your inputs and hosted on your HayaWeb website is made available to you. You may use it for your business purposes. However, because AI-generated content is derived from models trained on large datasets, HayaWeb cannot guarantee that the generated output is unique or free from similarity to other content.

Accuracy Disclaimer. AI-generated content may contain inaccuracies, errors, or omissions. You are responsible for reviewing and approving all content before publishing your website. HayaWeb is not liable for any loss or damage caused by reliance on AI-generated content.

No Legal or Professional Advice. AI-generated content does not constitute legal, financial, medical, or any other professional advice.

Our Rights. HayaWeb retains all rights to the AI models, algorithms, and underlying technology used to generate content.

Subdomains. Free and paid users may publish websites to a yourbusiness.hayaweb.ai subdomain. You do not own this subdomain; it is licensed to you as part of the Service. We reserve the right to reclaim or reassign subdomains that are inactive, abusive, or violate these Terms.

Custom Domains (Pro & Agency). You may connect a domain you own to your HayaWeb website. You are responsible for purchasing, renewing, and managing your domain through a third-party registrar. HayaWeb is not responsible for domain expiry or DNS configuration issues.

White-Label (Agency). Agency users may present HayaWeb-built websites to their clients without HayaWeb branding. You remain responsible for your clients' compliance with these Terms. You may not misrepresent the underlying technology or claim to have built the AI infrastructure yourself.

Uptime. We strive for maximum availability but do not guarantee 100% uptime. Planned or unplanned maintenance may cause temporary downtime. HayaWeb is not liable for losses caused by service interruptions.

Content on Published Sites. Your published website is publicly accessible. You are solely responsible for all content that appears on your website, including AI-generated content that you approved for publishing.

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation
• Create websites promoting illegal products or services, including unlicensed businesses
• Publish false, misleading, or fraudulent business information
• Infringe or misappropriate any third party's intellectual property, privacy, or publicity rights
• Impersonate any person, business, or entity
• Upload malware, viruses, or any malicious code
• Use the Service to send spam, phishing messages, or unsolicited communications
• Attempt to gain unauthorized access to our systems, other users' accounts, or any connected networks
• Scrape, crawl, or extract data from the Service using automated means without our prior written consent
• Reverse-engineer, decompile, or attempt to extract the source code of our platform
• Resell, sublicense, or otherwise commercialize the Service without our authorization (except as permitted under the Agency plan)
• Use the Service to generate websites that compete with HayaWeb's core business without a white-label agreement
• Circumvent plan limits by creating multiple accounts
• Generate websites containing adult content, hate speech, discriminatory content, or content promoting violence

Violation of these prohibitions may result in immediate account suspension and potential legal action.

HayaWeb's IP. The HayaWeb platform, including its AI models, algorithms, source code, design, trademarks, logos, and all underlying technology, is owned exclusively by HayaWeb and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, or logos.

Feedback. If you provide suggestions, ideas, or feedback about the Service, you grant HayaWeb a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without compensation to you.

DMCA. If you believe that content on a HayaWeb-hosted website infringes your copyright, please send a written notice to legal@hayaweb.ai including: (a) a description of the copyrighted work; (b) the URL of the infringing content; (c) your contact information; and (d) a statement of good faith belief and accuracy under penalty of perjury.

The Service integrates with third-party services including AI model providers, cloud infrastructure, payment processors, and domain services. Your use of these third-party services is subject to their own terms of service and privacy policies. HayaWeb is not responsible for the practices or content of third-party services.

Links to third-party websites on HayaWeb-hosted pages are your responsibility. We do not endorse any linked third-party content.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT.

HayaWeb does not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) any AI-generated content will be accurate, complete, or suitable for any purpose; (c) your website will rank in search engines or generate business leads; or (d) any defects will be corrected.

Results vary. Past performance of AI-generated websites does not guarantee specific outcomes for your business.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HAYAWEB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITIES, OR GOODWILL — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL HAYAWEB'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO HAYAWEB IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless HayaWeb and its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your published website and its content; (d) your violation of these Terms; or (e) your violation of any third-party rights.

By You. You may cancel your account at any time by contacting us at legal@hayaweb.ai. Upon cancellation, your websites will be unpublished and your data deleted after a 30-day grace period.

By Us. We reserve the right to suspend or terminate your account immediately, without notice or refund, if we determine (at our sole discretion) that you have violated these Terms, engaged in fraudulent activity, or pose a risk to our platform or other users.

Effect of Termination. Upon termination, your right to access and use the Service ceases immediately. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — shall survive.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the United States. You waive any objection to jurisdiction or venue in such courts.

Dispute Resolution. Before filing any legal action, you agree to attempt to resolve disputes informally by contacting us at legal@hayaweb.ai. We will attempt to resolve the dispute within 30 days.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via email and update the effective date at the top of this page. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and cancel your account.
